Government moves to harmonise Aadhaar Act with new data protection laws

The government on Wednesday instructed the Unique Identification Authority of India (UIDAI) to work on harmonising the Aadhaar Act with data protection rules.

“When Aadhaar law was made that time we didn’t have a horizontal law on data protection and privacy. But, now we have Digital Personal Data Protection Act, 2023 and its rules are in the final stages. Just like we had consultations during the Act was made, similar extensive consultations are going on for the rules and now those consultations are almost over and we will soon notify the rules also,” Ashwini Vaishnaw, Minister of Electronics and Information Technology, said.

India can have the advanced, modern legal framework of the Aadhaar Act that focuses on users at the center of the entire legislation, he said on a video post on X.

“We need to see how the Aadhaar Law can be harmonised now vis-à-vis the DPDP Act, that is the task I would request UIDAI to take as one of the major tasks going forward because when the Aadhaar Act was enacted that time there were many gaps in the legal structure,” Vaishnaw noted.

He said keeping the common citizen at the centre of the legislation and developing the new legal structure can really improve the lives of the millions of people who are using Aadhaar.

“There are a variety of uses. For all of them, there should be no need to give consent again and again, to provide data in different places, to get cards or authentication in different places. They should not have to do all of that. If such a legal framework is made, a poor mother should have the easiest way for all of her services. That should be the objective of this law,” Vaishnaw said.

A face authentication app

On Tuesday, the Minister discussed introducing a face authentication app for Aadhaar-based transactions that can strengthen and accurately authenticate authorisations. A beta version of the app was also launched.

“To make authorisation strong, finger print, iris or face is used. Facial recognition is easiest because it can be done using your own mobile phone. Soon the final version (of the beta version) will be released. We will need to keep its large back up. They (UIDAI) are working out on back up server capacity…in the next few months it will be rolled out fully,” he added.
